HIPAA PRIVACY PRACTICES NOTICE

At SilverSwing ABA, we are committed to safeguarding the privacy and confidentiality of our Clients’ protected health information (PHI) in compliance with the Health Insurance Portability and Accountability Act (HIPAA) and its privacy rules. This Notice of Privacy Practices explains how we may use and disclose your PHI and your rights concerning your health information.

Uses and Disclosures of PHI

We may use and disclose your PHI for treatment, payment, and healthcare operations. This includes sharing information with our clinical team, insurance companies, billing entities, and other healthcare providers directly involved in the Client’s care. Your PHI may also be used for different purposes as permitted or required by law, such as public health reporting or law enforcement.

Privacy Rights

As a client, you have the following rights related to your PHI:

  1. Right to Access: You can review and obtain a copy of your PHI records, with certain exceptions.
  2. Right to Request Restrictions: You can request restrictions on how we use or disclose your PHI, although we are not required to agree to these requests in all cases.
  3. Right to Amend: If you believe your PHI is incorrect or incomplete, you can request amendments or additions to your records.
  4. Right to Accounting of Disclosures: You have the right to receive a list of certain disclosures of your PHI that we have made in the last six years.
  5. Right to Opt-Out of Marketing Communications: You can opt-out of receiving marketing materials from us.

PHI Security

We take the security of your PHI seriously. We have implemented physical, electronic, and administrative safeguards to protect your information from unauthorized access, use, or disclosure.

Breach Notification

We will notify you in a timely manner as required by law in the event of a breach of your unsecured PHI.

Notice Changes

We reserve the right to modify or update this Privacy Practices Notices, as needed. Our most current version is available on our website.

Our Clients’ privacy is of utmost importance to us, and we are dedicated to maintaining the confidentiality of PHI in compliance with HIPAA.  If you have any questions about our HIPAA privacy practices or wish to file a complaint, you may do so by contacting our HIPAA Compliance Officer directly by clicking here.

If you feel your privacy rights are violated; you may file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights by sending a letter to 200 independence Avenue S.W., Washington, D.C. 20201, calling 1-877-696-6775, or visiting www.hhs.gov/ocr/privacy/hipaa/complaints/

The effective date of this notice was February 2024. It was last amended effective December 2025.
